Non-Resident Indians face tax threat under new code

Direct Taxes Code does away with certain provisions that protected Indians abroad from taxes

The Economic Times' has reported.

The new legislation, introduced in Parliament 
on Monday, says an individual shall be resident in Indiain any financial year if he is in the country for more than 59 days in that year and has been in India for more 365 days in the four preceding financial years.

A number of Indian industrialists including Vedanta's 
Anil Agarwal and Essar's Ravi Ruia have acquired non-resident status over the years.

"The DTC has only attempted to clean up the provision in line with the laws globally," the daily quoted an official with the central board of direct taxes (CBDT), the apex 
direct tax arm of the government, as saying.

A phrase "being outside India" in the existing 
income tax law exempted individuals who stay outside the country for six months from paying taxes. This was prone to misuse and allowed individuals to escape tax in any country, the official said, requesting anonymity.

The new code is expected to come into effect from 
April 1, 2012.

More than 25 million Indians stay overseas and one million visit the country every year. A large number of NRIs particularly those working in the gulf countries usually visit India for longer durations.

"This could result in a situation wherein the overseas income of NRIs may be subject to tax under certain situations," said Vikas Vasal, executive director at consulting firm KPMG.
Amitabh Singh, partner at Ernst & Young, said this could become a dampener for the overseas Indian population who routinely visit India to meet their relatives and friends.

"They will now have to restrict their stay to less than 60 or be in danger of becoming tax residents," he said.

NRIs who have spent 365 days in the last four years, which is permissible under the current income tax law, are at the risk of becoming a resident and facing tax on their global income.

They will be given relief from payment of tax for two years on their global income in the transition period when they become resident from non-resident, a CBDT official said.

The 
income tax department can define the term "visit" more tightly to ensure that there is no misuse instead of removing the provision altogether, Mr Singh of Ernst & Young said.

History of Railroad Tracks

RAILROAD TRACKS

The   US  standard railroad gauge (distance between the rails) is 4 feet, 8.5 inches. That's an exceedingly odd number.
Why was that gauge used?
Because that's the way they built them in England and English expatriates designed the US railroads.
Why did the English build them like that?
Because the first rail lines were built by the same people who built the pre-railroad tramways and that's the gauge they used. 
 
 Why did 'they' use that gauge then?
Because the people who built the
tramways used the same jigs and tools that they had used for building wagons, which used that wheel spacing.
Why did the wagons have that particular odd wheel spacing?
Well, if they tried to use any other spacing, the wagon wheels wouldbreak on some of the old, long distance roads in England , because that's the spacing of the wheel ruts.
So who built those old rutted roads?
Imperial   Rome built the first long distance roads in Europe (including   England ) for their legions. Those roads have been used ever since.
 And the ruts in the roads?
Roman war chariots formed the initial ruts, which everyone else had to match for fear of destroying their wagon wheels. 
 Since the chariots were made for Imperial Rome , they were all alike inthe matter of wheel spacing.

Therefore the United States standard railroad gauge of 4 feet, 8.5 inches is derived from the original specifications for an Imperial Roman war chariot. Bureaucracies live forever. 
The next time you are handed a specification/procedure/process and wonder 'What horse's ass came up with this?', you may be exactly right. Imperial Roman army chariots were made just
wide enough to accommodate the rear ends of two war horses.

Now - the twist to the story:
A Space Shuttle sitting on its launch pad has two big booster rockets attached to the sides of the main fuel tank. These are solid rocket boosters, or SRBs. The SRBs are made by Thiokol at a factory in Utah . Engineers who designed the SRBs would have preferred to make them a bit fatter, but the SRBs had to be

The tunnel is slightly wider than the railroad track, and the railroad track, as you now know, is about as wide as

So, a major Space Shuttle design feature of what is arguably the world's most advanced transportation system, was determined over two thousand years ago by the width of a horse's ass!

travelling in an autorickshaw. They met with an accident and all three of
them died.
Yama Raja was waiting for this moment at the doorstep of death.

He asks Mrs GANDHI and Advani to go to HEAVEN.

But, for Laloo, Yama had already decided that he should be sent to HELL.
Laloo is not at all happy with this decision.

He asks Yama as to why this discrimination is being made. All the three of
them had served the public. Similarly, all took bribes, all misused public
positions, etc.

Then why the differential treatment?

He felt that there should be a formal test or an objective evaluation before
a decision is made; and should not be just based on opinion or pre-conceived
notions.



Yama agrees to this and asks all the three of them to appear for an English
test.

Mrs GANDHI is asked to spell " INDIA " and she does it correctly.

Advani is asked to spell " ENGLAND " and he too passes.

It is Laloo's turn and he is asked to spell " CZECHOSLOVAKIA ".

Laloo protests that he doesn't know English.

He says this is not fair and that he was given a tough question and thus
forced to fail with false intent.



Yama then agrees to conduct a written test in Hindi (to give another chance
assuming that Laloo should at least feel that Hindi would provide an equal
platform for all three).

Mrs GANDHI is asked to write "KUTTA BOLA BHOW BHOW". She writes it easily and
passes.

Advani is asked to write "BILLY BOLI MYAUN MYAUN". He too passes.

Laloo is asked to write "BANDAR BOLA GURRRRRR....."
Tough one. He fails again.



Laloo is extremely unhappy.

Having been a student of history (which the other two weren't),he now
requested for all the 3 to be subjected to a test in history

Yama says OK but this would be the last chance and that he would not take
any more tests.

Mrs GANDHI is asked: "When didIndia getIndependence ?". She replied "1947" and
passed.

Advani is asked "How many people died during the independence struggle?".

He gets nervous. Yama asked him to choose from 3 options: 100,000 or 200,000
or 300,000.
Advani catches it and says 200,000 and passes.

It's Laloo's turn now.

A QUIZ FOR PEOPLE WHO KNOW EVERYTHING 

There are only nine questions.

This is a quiz for people who know everything!  
I found out in a hurry that I didn't.  
These are not trick questions.  
They are straight questions with straight answers.
